Acceptance

By accessing and using the ForestRush LTD website, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this service. We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms.

Products and pricing

All descriptions of our premium board games, component specifications, and product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. All prices are listed in Canadian Dollars (CAD) unless otherwise noted. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.

Orders

When you place an order on our site, it constitutes an offer to buy the products listed in your cart. We will send you an order confirmation email indicating that we have received your offer. This email does not constitute acceptance of your order. Order acceptance and the formation of the contract of sale between ForestRush LTD and you will not take place unless and until you have received your order confirmation email and your payment has been successfully processed. We reserve the right to decline or cancel any order for any reason, including stock limitations, inaccuracies in product pricing, or suspected fraudulent activity.

Shipping

We are dedicated to ensuring your physical board games arrive in pristine condition. Delivery times are estimates and commence from the date of shipping, rather than the date of order. Delivery times are to be used as a guide only and are subject to the acceptance and approval of your order. Unless there are exceptional circumstances, we make every effort to fulfill your order within 2 business days of the date of your order. Business day means Monday to Friday, except holidays. Please note we do not ship on Sundays. Shipping costs are calculated based on the weight of your order and the delivery method. To find out how much your order will cost, simply add the items you would like to purchase to your cart, and proceed to the checkout page.

Limitation of liability

To the fullest extent permitted by applicable law, in no event will ForestRush LTD, its affiliates, directors, employees, or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages.

Governing law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Kingdom, specifically under the jurisdiction of the courts of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the English courts.
